This Publisher Notice (“Notice”) is issued by:
Olarm (Pty) Ltd, Registration No. 2015/057946/07, incorporated in the Republic of South Africa, principal office at 3rd Floor, 325 Main Road, Kenilworth, Cape Town, 7708, South Africa.
When this Notice refers to “Olarm”, “we”, “us”, or “our”, they refer to Olarm (Pty) Ltd as the publisher and content owner of the Newsletters.
For the purposes of this Notice, the following terms have the meanings set out below:
Term - Definition
Olarm - Olarm (Pty) Ltd (Reg. 2015/057946/07), 3rd Floor, 325 Main Road, Kenilworth, Cape Town, 7708, South Africa.
Newsletter(s) - Any newsletter, bulletin, digest, or editorial publication authored or commissioned by Olarm, including the Signalling newsletter and any other Olarm-branded or Olarm-attributed publication distributed via any Platform.
Platform(s) - The third-party websites and services through which the Newsletters are hosted and distributed, including but not limited to signalling.co.za, theopenletter.io, and the Beehiiv newsletter infrastructure.
Operator - Any third-party entity engaged by Olarm to manage, operate, or distribute the Newsletters on Olarm’s behalf, including The Open Letter. The Operator acts as a service provider to Olarm and does not own the Newsletter Content.
Subscriber - Any person who has subscribed to receive the Newsletter via email, a Platform, or any other distribution channel.
Reader - Any person who accesses, views, or reads the Newsletter Content, whether or not they are a Subscriber.
You / Your - The Subscriber or Reader accessing or using Newsletter Content, as the context requires.
Newsletter Content - All text, articles, analysis, commentary, data, graphics, images, logos, and other material published in or forming part of any Newsletter, authored or commissioned by Olarm.
Intellectual Property - All copyright, trademarks, trade names, service marks, logos, database rights, and any other intellectual property rights in the Newsletter Content, whether registered or unregistered.
Personal Information - Any information relating to an identified or identifiable natural person, as defined under applicable data protection legislation in your jurisdiction.
Applicable Data Protection Law - The data protection and privacy legislation applicable in your jurisdiction, including, without limitation POPIA (South Africa), the UK GDPR and Data Protection Act 2018 (United Kingdom), the EU GDPR (European Union), and equivalent legislation in other territories.
2.1 This Notice governs your access to, use of, and subscription to Olarm’s Newsletters and Newsletter Content, regardless of the territory from which you access them.
2.2 By subscribing to, reading, or otherwise accessing any Newsletter or Newsletter Content, you confirm that you have read and agree to be bound by this Notice and by Olarm’s Privacy Policy, available at https://olarm.com/legal/privacy-policy.
2.3 IF YOU DO NOT AGREE TO THIS NOTICE, DO NOT SUBSCRIBE TO OR ACCESS THE NEWSLETTERS.
2.4 This Notice applies in addition to any terms of use of the Platform through which you access the Newsletter. In the event of a conflict between this Notice and any Platform’s terms regarding the ownership and use of Newsletter Content, this Notice shall prevail as between you and Olarm.
3.1 Olarm is the publisher and owner of all Newsletter Content. The Newsletters are distributed through third-party Platforms and managed by Operators on Olarm’s behalf.
3.2 The Platforms and Operators are independent third parties. They are authorised by Olarm to distribute and manage the Newsletters, but do not own, and have no rights to commercially exploit, the Newsletter Content except as expressly authorised by Olarm in writing.
3.3 Olarm’s engagement of a Platform or Operator does not create any partnership, agency, or joint venture between Olarm and that party in respect of any dealings with Subscribers or Readers.
3.4 The underlying newsletter infrastructure is hosted by Beehiiv. By subscribing, you also become subject to Beehiiv’s subscriber terms, available at https://www.beehiiv.com/tou. Olarm is not responsible for Beehiiv’s platform policies or any changes to them.
4.1 All Newsletter Content is the exclusive intellectual property of Olarm (Pty) Ltd. All rights not expressly granted in this Notice are reserved.
4.2 The names “Olarm” and all associated logos, marks, and trade names used in connection with the Newsletters are trademarks or trade names of Olarm. You may not use any of these marks without Olarm’s prior written consent.
4.3 Permitted use: You may read, download for personal use, and share individual articles or newsletter issues, provided that:
you include a clear attribution in the form: “Source: Olarm / Signalling — https://www.signalling.co.za”;
the content is shared in its original, unaltered form; and
the sharing is non-commercial and for informational purposes only.
4.4 Prohibited use: Without Olarm’s prior written consent, you may not:
reproduce, republish, or redistribute Newsletter Content in bulk or in its entirety, whether in print, digital, or any other format;
use Newsletter Content for commercial purposes, including but not limited to incorporation into paid publications, marketing materials, or subscription products;
use Newsletter Content to train, fine-tune, or otherwise develop artificial intelligence, machine learning, or large language models;
scrape, crawl, or systematically extract Newsletter Content using automated tools;
remove, alter, or obscure any copyright notice, attribution, or trademark notice included in the Newsletter Content; or
present Newsletter Content as your own original work.
4.5 Requests for permission to reproduce or commercially use Newsletter Content should be directed to [email protected].
4.6 The Platforms are granted a limited, non-exclusive licence by Olarm to host and distribute the Newsletter Content solely for the purpose of delivering the Newsletters to Subscribers and Readers. This licence does not transfer any ownership of Intellectual Property to any Platform or Operator.
5.1 When you subscribe to a Newsletter, Olarm (acting through its Operators and the Beehiiv platform) collects your email address and, where provided voluntarily, your name and professional details. Olarm may also collect basic engagement data, such as open rates and click activity.
5.2 Your Personal Information is processed by Olarm as the responsible party / data controller, in accordance with Applicable Data Protection Law and Olarm’s Privacy Policy at https://olarm.com/legal/privacy-policy. Where you are located outside South Africa, Olarm will apply the data protection standards required by the laws of your jurisdiction to the extent those laws apply to Olarm’s processing of your Personal Information.
5.3 Olarm does not sell your Personal Information to third parties. Your email address and subscription data may be shared with Operators and the Beehiiv platform solely for the purpose of delivering and managing the Newsletters.
5.4 You may unsubscribe from any Newsletter at any time by clicking the unsubscribe link included in every newsletter email or by contacting [email protected]. Unsubscribing will not affect any rights you have under Applicable Data Protection Law, including the right to request access to, correction of, or deletion of your Personal Information.5.5 Olarm retains subscriber data only for as long as is necessary for the purposes of delivering the Newsletter and as required by applicable law.
6.1 Newsletter Content is published for general industry information and commentary purposes only. Nothing in any Newsletter constitutes or should be construed as:
legal, regulatory, or compliance advice;
financial, investment, or commercial advice;
technical, engineering, or security advice; or
an endorsement of any product, service, company, or individual mentioned.
6.2 Olarm makes reasonable efforts to ensure that Newsletter Content is accurate and current at the time of publication. However, Olarm gives no warranty or representation, express or implied, as to the accuracy, completeness, or fitness for any particular purpose of any Newsletter Content.
6.3 Olarm accepts no liability for any loss, damage, cost, or expense of any nature arising directly or indirectly from your reliance on or use of Newsletter Content, to the fullest extent permitted by applicable law.
6.4 Nothing in this Notice excludes or limits any rights you may have under the mandatory consumer protection legislation of your jurisdiction that cannot lawfully be excluded or limited.
7.1 Newsletters may contain links to, or references to, third-party websites, products, companies, or services. Such links and references are provided for convenience and informational purposes only.
7.2 Olarm does not endorse and is not responsible for the content, accuracy, or practices of any third-party website or service, and your access to and use of any third-party site is at your own risk and subject to that third party’s terms and conditions.
7.3 Where Newsletter Content is commercially supported, sponsored, or produced in partnership with a third party, this will be clearly disclosed within the relevant newsletter issue using labels such as “Sponsored”, “Advertiser Content”, or “In Partnership With”. Non-disclosed content represents Olarm’s independent editorial view.
8.1 Olarm may update this Notice from time to time. Material changes will be notified to Subscribers via the Newsletter or by email with reasonable advance notice. Your continued subscription or access to Newsletter Content after the effective date of any amendment constitutes acceptance of the updated Notice.

9.1 This Notice is governed by the laws of the Republic of South Africa. Olarm (Pty) Ltd is the publisher and responsible party for all Subscribers and Readers regardless of territory.
9.2 Any dispute arising out of or in connection with this Notice shall, in the first instance be referred to Olarm at [email protected] for resolution.
9.3 Where mandatory law in your jurisdiction confers rights upon you that cannot be displaced by a choice of governing law — including rights to bring proceedings in local courts or to benefit from local consumer protection legislation — those rights are not affected by this Notice.
